Rules for using the FRAMECULT release desk.
If anything on the marketing site, in-app copy, or checkout screens conflicts with these Terms, these Terms control except where mandatory consumer protection law in your country says otherwise.
1. Acceptance of Terms
By accessing or using FRAMECULT (“the Service”, “we”, “us”, or “our”), you agree to these Terms of Service. If you disagree, do not use the Service.
2. Description of Service
FRAMECULT provides an AI-assisted release artwork workflow for music releases. You provide release text (for example artist name, track title, and mood notes), select a visual lane, and the Service generates image outputs and optional export packages.
Credits. Paid plans and certain passes include a monthly or one-time pool of credits used for billable actions described at checkout and in-product (for example cover builds, format rebuilds, high-resolution production exports, and optional metadata exports). Credit rules, refresh cadence, and whether unused credits roll over are stated at purchase; unless expressly stated, subscription credits refresh each billing period and do not roll over.
Trial outputs. We may offer complimentary credits so you can evaluate the Service. Trial outputs may be technically limited (for example resolution, watermarking, compression, or export restrictions). Those limits do not by themselves expand the license in Section 3.
3. Intellectual Property, Outputs, and License Grants
- Your inputs. You retain rights to original text and concepts you submit, and you represent you have the rights needed for us and our subprocessors to process them to run the Service.
- Trial and free promotional outputs. Outputs produced using only complimentary or trial allocation (before you have a paid entitlement that covers the applicable deliverable) are licensed to you for personal, non-commercial evaluation only, unless we say otherwise in writing. Without limiting the foregoing, you agree not to use trial-only outputs for commercial streaming distribution, paid advertising, merchandise for sale, or other revenue-generating exploitation until you have obtained Paid Outputs as described next.
- Paid Outputs. When you have an active paid subscription, Day Pass balance, or other prepaid entitlement, and we successfully deliver a cover build or production export and record the corresponding credit charge (or include the action at no extra charge under the plan you purchased), FRAMECULT grants you a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, publicly display, and create derivative works from the delivered image files for commercial music releases, release-related marketing, and merchandise for your own releases, subject to these Terms and applicable law. This license applies to the delivered files as provided by the Service, not to underlying model weights, training data, or FRAMECULT software.
- Third parties. You are responsible for how you use Outputs, including clearing rights in any likenesses, trademarks, or third-party materials that may appear if you add your own reference material where the product allows it.
- FRAMECULT platform IP. The FRAMECULT platform, including its code, lane systems, typographic overlays, prompts, workflows, and branding, remains our property and our licensors’ property.
4. Acceptable Use
You agree not to use the Service to generate or distribute content that:
- Is illegal, fraudulent, harmful to minors, or intended to harass, threaten, or incite violence;
- Infringes or misappropriates any third party’s intellectual property, publicity, or privacy rights;
- Impersonates another person or organization in a misleading way;
- Attempts to scrape, resell, or automate the Service in a way that violates rate limits, bypasses billing, or harms operation.
We may suspend or terminate accounts that violate these rules or create legal or security risk.
5. Payments, Billing, and Taxes
Payments are processed by Polar.sh as merchant of record. Card and wallet data are handled by Polar; we do not store full payment card numbers on FRAMECULT servers.
Subscriptions renew until cancelled. Cancellation generally takes effect at the end of the current billing period as shown in your billing portal. Taxes such as VAT or sales tax may be collected and remitted by the processor where applicable.
Consumer rights. Nothing in these Terms limits mandatory consumer protection rights in your country of residence, including any statutory withdrawal, cooling-off, or refund rights that apply to your purchase of digital content or services.
Refunds. Our refund rules are described on the Refund Policy page, which is incorporated into these Terms by reference.
6. Disclaimers and Limitation of Liability
Disclaimer. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Outputs will meet distributor rules, platform policies, or your subjective creative expectations; you remain responsible for final QC before release.
Limitation. To the fullest extent permitted by law, FRAMECULT and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, goodwill, or data, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amounts you paid to FRAMECULT for the Service in the three months before the event giving rise to the claim, or (b) fifty US dollars (USD $50), except where mandatory law does not permit such a cap.
7. Indemnity
You will defend and indemnify FRAMECULT and its operators against any third-party claims, damages, or costs (including reasonable attorneys’ fees) arising from your inputs, your use of Outputs in violation of these Terms, or your violation of applicable law.
8. Changes to Terms
We may modify these Terms. If changes are material, we will provide reasonable notice by posting the updated Terms on this page and updating the “Last updated” date. Continued use after the effective date constitutes acceptance of the revised Terms.
